Litigation and Disputes: Here's what we can do
Representation Before All Adjudicative Bodies
Representing clients in all Israeli courts, including Magistrates’ Courts, Family Courts, Rental Tribunals, District Courts, the Supreme Court, and the High Court of Justice. Our services also cover Administrative Courts, appeals committees in various fields, and the Enforcement and Collection Authority. We regularly handle urgent remedies such as injunctions, stay-of-exit orders, temporary attachments, interim measures, and cross-border relief.
Civil and Commercial Litigation
Representing clients in the full spectrum of commercial disputes, including financial claims, breaches of contract, violations of commercial agreements, business torts, shareholder disputes, corporate dissolution, derivative actions, and insolvency proceedings. We also represent clients in banking litigation, including bank claims against debtors and guarantors, and asset receivership proceedings — sometimes even within Family Court when intertwined with family disputes.
Real Estate and Planning Disputes
Handling disputes across real estate and land law, including:
-
Enforcement or rescission of real estate sale agreements and damages for breach.
-
Receivership for sale of real estate or registration of condominiums (against negligent contractors).
-
Landlord–tenant disputes, including evictions, lease breaches, debt recovery, and protected tenancy claims (eviction, change of use, or cost-sharing).
-
Planning and zoning litigation, including administrative petitions for approval or cancellation of master plans and building permits, as well as compensation claims under Section 197 of the Planning and Building Law.
-
Condominium disputes before the Condominium Registrar, including claims against committees or owners, use of common property, and proceedings against dissenting tenants in urban renewal projects.
-
Partition of real property and disputes over expropriations, including annulment of proceedings or compensation claims.
Inheritance Disputes
Longstanding expertise in representing heirs and beneficiaries in inheritance disputes, including objections to probate, contested wills, allegations of undue influence, lack of testamentary capacity, and formal defects. Services include objections to probate and inheritance orders, revocation proceedings, appointment of estate administrators, and litigation before all relevant courts.
Administrative and Regulatory Representation
Representing clients before public and municipal authorities, including local, district, and national planning committees. We file objections, appeals, and administrative petitions regarding master plans, permits, expropriations, taxation matters, and other regulatory issues.
Complex Litigation
Extensive experience handling legally, factually, and financially complex disputes, often involving large volumes of documentation, multiple parties, and broad implications. We combine in-depth analysis, advanced case management tools, and strategic perspective to achieve optimal results.
Case Assessment and Legal Strategy
Prior to initiating proceedings, we conduct a thorough assessment of the case, including prospects of success, economic implications, and broader impact on the client. Based on this analysis, we build a tailored legal strategy — whether pursuing litigation or opting for alternative solutions such as negotiation, mediation, or arbitration. This approach ensures informed, cost-effective, and client-focused decision-making.
Arbitration, Mediation, and Dispute Resolution
Representing clients in arbitration and mediation, both domestic and international. When appropriate, we propose alternative strategies designed to avoid lengthy and costly litigation. Advocate Alon Samuel also serves as an arbitrator in commercial disputes, appointed by judges of the Israeli courts.
Appeals
Handling appeals before District Courts, the Supreme Court, Administrative Courts, and appeals committees. Our firm is well-known for achieving significant appellate victories, including landmark Supreme Court precedents in planning and zoning law, expropriations, contract law, civil procedure (protected tenancy), and criminal procedure (planning and building offenses).
Tax Disputes and Representation before Authorities
Representing individuals and organizations in tax disputes involving real estate taxation, corporate and nonprofit taxation, capital gains, and more. Services include filing objections, administrative proceedings before appeals committees, representation before the tax authorities, and litigation in District Court and the Supreme Court.
