• On 12 September 2013 an Israeli court granted Adam Teva vaDin's
petition and struck out a municipal plan (רג\מק\340\ג\30\א\1) that allowed greater density (than otherwise allowed by applicable law) in TMA 38 (i.e., National Masterplan No. 38) projects, where existing residential buildings are torn down, to be replaced with new buildings (referred to as Small Urban Renewal Projects) in the city of Ramat Gan. • Amendment 76 of the Real Estate Tax Act (acquisition and
improvement) of 1963 (hereinafter, "the Act"), has significantly narrowed the range of tax exemption on real estate improvement (a form of capital gains tax applied to real estate) when selling a residential apartment. Most of the changes are as follows :
• Our office filed claims seeking compensation due to
exercise of eminent domain for a portion of a lot that was not expropriated but, following a series of expropriations of portions of the same lot, became inaccessible and impossible to improve
• Our office filed dozens of appeals, in accord with the
provisions of § 197 of the Act, due to a sweeping rejection of claims for compensation by the local committee for planning and construction in Tel Aviv; compensation that was sought as a result of harm caused when, without actually employing eminent domain, the municipality put into effect a plan for preservation of certain structures in Tel Aviv which deprived owners of the use and benefit of their property
• Lately, our office accomplished a feat at the Supreme Court
(of Israel) regarding the applicability of the statute of limitations to an a agreement receiving the validity of a judgment. The issue was whether such agreement is subject to the usual statute of limitations provisions or should it be treated as a judgment (25 years).
• Our office filed a petition with the High Court of Justice,
attacking the applicability and limitations sections of the Act Amending the Land Acquisition for Public Purposes Decree (2010).
